The minister, of the, determined on Wednesday (20) that the defense of the former president (PL) presents explanations, within 48 hours, over the successive breaches of precautionary measures imposed by the Court. “The defense of Jair Messias Bolsonaro is summoned so that, within 48 (forty-eight) hours, to clarify: the repeated non-compliance with the precautionary measures imposed; the reiteration of illicit conduct; and the existence of proven risk of escape,” wrote the minister. In the decision, Moraes also cites recurrence in illicit conduct attributed to the former president and the “proven risk of escape”, appointed in a recent report by the Federal Police (PF).

Among the elements that reinforce the concern of the Court is the seizure of a draft of political asylum in Argentina, dated February 2024. The document was produced a few days after the operation of the PF that fulfilled a search and seizure warrant against Bolsonaro. According to Moraes, “the evidence obtained by the Federal Police indicate that Jair Messias Bolsonaro had a document intended to enable its evasion of the national territory.” Following the manifestation of the defense, Moraes determined that the records be sent immediately to the Attorney General’s Office (PGR), which will have the same period of 48 hours to present its position.
