(Reuters)-Elon Musk tried to enlist rival Mark Zuckerberg for an offer of $ 97.4 billion his consortium made for OpenAi earlier this year, but the executive president of the goal did not accept, OpenAi said in a lawsuit on Thursday.
OpenAi, ChatgPT’s creator, said Musk had communicated with Zuckerberg about possible financing agreements or investment related to OpenAi supply, according to the court proceedings.
OpenAi said Musk had revealed its communications with Zuckerberg about the company during interrogations under oath.

Musk, whose Xai competes with OpenAi, could not be contacted immediately to comment on the matter. Xai did not speak up.
OpenAI has requested a US federal judge an order for the goal to produce documents and communications related to any OpenAi purchase offer, and those “referring to any Royal Restructuring or RECAPITALIZATION OR POTENTIAL OPENAI”.
“Communications of the goal with other stakeholders, or internal communications, including those that reflect discussions with Musk or other bidders, would also clarify the motivations of the offer,” said OpenAi, calling Musk and goal of two of their most important competitors.

The goal, in the same lawsuit, said that OpenAi should seek any relevant documents directly with Musk and its AI startup, and asked the judge to deny the Openii motion.
“The goal’s own communications regarding the restructuring or recapitalization of OpenAI (even if restricted) are not relevant to this action,” the goal added in the judicial process.
In early August, US District Judge Yvonne Gonzalez Rogers decided that Musk must face OpenAi’s allegations that the billionaire, through press statements, social media publications, “a false offer for OpenAi assets”, tried to harm the AI startup.

Musk sued OpenAi and its executive president, Sam Altman last year because of the company’s transition to a profitable model, after which OpenAi countered Musk in April this year.
A trial with jury was scheduled for 2026.
