Text replaces the end of the privileged forum, requested by the opposition
The proposal for amendment to the Constitution (PEC) which aims to protect deputies and senators from lawsuits, precautionary measures and arrests should advance next week in the House of Representatives. Call of the PEC of prerogatives, the text must propose that processes against parliamentarians should only occur after the plenary of the House or Senate. The proposal will be discussed by the rapporteur with party benches between Monday and Tuesday, with a chance of voting until Thursday.
The text will be changed over an existing PEC of 2021, which deals with the same theme. The proposal is being reported by Deputy Lafayette Andrada (Republicans-MG). The original PEC, which will still be modified, already foresees some guarantees for parliamentarians, such as:
- Judgment of opinions, words and votes should only occur in the National Congress Ethics Councils, not in the judicial scope;
- The arrest in the act may only occur in cases of unenforceable crimes, the detention should also be analyzed by the plenary of houses within 24 hours;
- Prohibited the precautionary removal of parliamentarians, only when decreed by the Congress itself, by the Electoral Court, or with judicial conviction.
- Right to the double degree of jurisdiction in the Supreme Court and STJ, that is, it is possible to resort to proceedings within the last instance cuts.
