The defense of former President Jair Bolsonaro (PL) asked the Supreme Court (STF) to reconside the decision that determined his house arrest. In a statement sent to Minister Alexandre de Moraes, lawyers claim that there are no new facts that justify the aggravation of precautionary measures.
Bolsonaro’s defense claims that it has complied with all judicial determinations, including the use of electronic anklet, the prohibition of traveling abroad and participation in hearings.
The defense also disputes the Federal Police report, classifying it as a “political piece” aimed at demoralizing the former president.
“If the clarifications requested, it is taken to request the reconsideration regarding the decision that determined the house arrest, or, if you do not understand, the urgent judgment of the regimental appeal filed by the defense,” says the text.
Lawyers also criticize the attempt to criminalize private messages exchanged by Bolsonaro, including US lawyer Martin de Luca, and point out that the former president did not respond to the message sent by Braga Netto, which, according to them, decharacterizes any contact.
The defense concludes that the precautionary measures have been interpreted elasticly and that the former president has respected all decisions of the Supreme Court.
“The elements pointed out in the decision will be duly clarified within the period signed by the Rapporteur Minister, observing, from the outset, that there was never the breach of any previously imposed precautionary measure,” said the lawyers.
“Once again it dangerously approaches a punishment for third party acts. Others chose to publish messages – of mere greeting – in their own social networks, but there is not one message from the petitioner [Bolsonaro] so guiding. On the contrary, he points out that he could not speak not to ‘complicate’. In addition, and beyond the absence of new or even contemporary facts, it is certain that there is no news of non -compliance with any of the precautions already imposed in this last one and a half year, ”said the defense.
