Former President Jair Bolsonaro’s defense told the Supreme Court (STF) that he did not break the precautionary measures established by Minister Alexandre de Moraes and maintains that the Federal Police report is a “political piece”.
“The Federal Police report causes astonishment. It fits as a political piece, with the aim of demoralizing a former president of the Republic (who, whether the police authorities or not, is still a political leader), exposing his private life and accusing him of so serious as it seems incredible, but much of the report is dedicated to a told-said,” said lawyer Celso Vilardi.
The defense criticizes the dissemination of Bolsonaro dialogues with his son, Deputy Eduardo Bolsonaro (PL-SP), and reports on his financial movements. The lawyers document also says that there is a “emptiness of evidence” in messages cited by the PF.

In one of these documents, the PF pointed out that the former president received $ 30 million in a period of one year between 2023 and 2024, among other transactions.
Vilardi wrote that the fact that Bolsonaro continued to communicate on WhatsApp with allies after the ban on using social networks, established by Moraes on July 18, does not configure non -compliance with that order.
“In neither decisions is there any mention of the use of WhatsApp or restriction on sending messages to the list of private contacts – which is not confused with social network,” the defense said. According to Vilardi, the report shows that Bolsonaro interrupted the dialogues with Eduardo after Moraes made this ban. “There is no need to talk or even suppose any illegality and non -compliance with the messages sent,” he wrote.

‘Former President did not escape to Argentina’
The defense also counteracts suspicions that the draft asylum request to Argentina President Javier Milei was a proof of the intention to escape Brazil and, therefore, would justify a pre -trial detention.
Vilardi states that the document found was ancient, 2024, and a possible arrest decree would require contemporary facts.
“The fact is that, with or without the draft, the former president did not escape. On the contrary, he obeyed all decisions emanating from C. Supreme Court, including the one that prohibited him from traveling abroad, responded to the complaint offered, attended all hearings always respecting all orders of this E. STF,” he argued.

The defense also states that there is no evidence of crimes in Bolsonaro dialogues with lawyer Martin de Luca, representative of the Rumble social network in action against Minister Alexandre de Moraes. It also argues that receiving a message by SMS from General Walter Braga Netto after the ban on communication between them had no response given by Bolsonaro, proving respect for the precautionary measure by the former president.
“The message was only received! No news of response. Without any reaction. Without any communication from the former president,” the defense said.
Now, Minister Alexandre de Moraes will send the process to a demonstration of the Attorney General, Paulo Gonet, about the eventual non-compliance with the precautions.
