The defense of () accused on Friday (22) the Federal Police of setting up a “political piece” by revealing content found on the former president’s cell phone. He also said that the draft asylum request directed to Argentina president Javier Milei, located on the phone, cannot be considered an attempted escape from Brazil or breach of precautionary measures by the Supreme Court (STF).
The demonstration was sent to the Court after Minister Alexandre de Moraes determine that the defense of the former president “the repeated non-compliance with the precautionary measures imposed, the reiteration of illicit conduct and the existence of proven risk of escape”, which would have been demonstrated by the PF.
The team led by lawyer Celso Vilardi told the Supreme Court that the draft asylum could not justify a pre-trial detention of the former president because it is not a “contemporary fact” and because there was no escape.
“It seems clear that a draft asylum request to the Argentine president, dating from February 2024, cannot be considered an evidence of escape,” he says.
“Fact is that, with or without the draft, the former president did not escape. On the contrary, he obeyed all the decisions” of the Supreme, “even that prohibited him from traveling abroad, responded to the complaint offered, attended all hearings, always respecting all orders” of the STF, complete.
The PF indicted Bolsonaro and his son Eduardo, deputy for the São Paulo PL, on suspicion of committing the crimes of coercion and abolition of the Democratic Rule of Law. According to investigations, they have articulated to bring Trump government officials to try to interfere with the trial of the 2022 and 2023 coup plot, in which the former president is a defendant.
The Federal Police also say that the former president has failed to order Moraes not to use his social network either through third parties. It will now be up to Moraes to evaluate the defense’s arguments and decide whether to manifest the PGR (Attorney General’s Office). One possibility is the minister to aggravate Bolsonaro’s situation with eventual pre -trial detention.
In addition to articulations by Eduardo in the US, the messages found on Bolsonaro’s cell phone revealed directed by the deputy to his father and Governor Tarcisio de Freitas (Republicans) and cursing Pastor Silas Malafaia to the former president’s son.
Coaf (Financial Activities Control) data analysis attached to the investigation also showed that Bolsonaro (PL) received about R $ 44.3 million in their bank accounts from March 2023 to June 2025, almost half in Pix.
In the document to the Supreme Court, Bolsonaro’s defense accuses the Federal Police of acting politically to “demoralize a former President of the Republic,” in order to expose his private life with accusations of serious and misplaced facts.
“The Federal Police report only demonstrates its partiality and recalls that this same Federal Police was responsible for screening all messages that were used by the prosecution in criminal proceedings [sobre a trama golpista]”, it says.
Vilardi and the other lawyers say the goal was achieved by PF: “Manchetes in Brazil and abroad announcing that the former president planned an escape. Nothing more false, but nothing more impactful, especially there is [sic] just over 10 days of the trial. “
To the Supreme Court, the defense also denied that Bolsonaro talked to former Minister Walter Braga Netto, also a defendant in the coup plot after the decision of Moraes of February 2024, which prohibited communication among the investigated.
The Federal Police said there is evidence of non -compliance with the precautionary measure for finding a message from SMS sent by the general to Bolsonaro hours after the prohibition determined by Moraes. There is no record of response from the former president.
“It’s amazing to have to say that the absence of response is the exact opposite of maintaining contact. This is why the attempt to say that the precautionary measure of 2024 had been promptly breached … with the silence of the former president,” he adds.
The report states that Bolsonaro and Eduardo tried to “directly reach Brazilian democratic institutions, notably the Federal Supreme Court and, even, the Brazilian National Congress, aiming to subdue them to personal and specific interests linked to the defendants judged within the aforementioned criminal action,” says the PF.
The investigation shows that the draft political asylum to the president of Argentina. The file would have been created and edited by a user in the name of Senator Flávio Bolsonaro’s wife (PL-RJ), according to investigators.
By collecting the response of the former president’s defense, the STF minister pointed to evidence of breach of precautionary measures, among other points, Bolsonaro dialogues with Pastor Silas Malafaia. The religious leader also had a cell phone and passport seized in operation last Wednesday.
For investigators, Malafaia encouraged Bolsonaro to break down the prohibition of networking and guided him about strategies for content dissemination. He also revised a letter from the former president that was published on social networks.
Investigators also said Bolsonaro and Eduardo used their wives in transactions to avoid resource blockages. Father and son used “various devices to conceal the origin and destination of financial resources, with the purpose of financing and supporting the activities of an illicit nature of the licensed parliamentary abroad,” according to the PF.
