Former President Jair Bolsonaro’s lawyer, Celso Vilari, said that “with or without draft, the fact is that former president did not escape”, in the clarifications given to the Supreme Court Minister (STF), Alexandre de Moraes.
“The police authority evidently knows – since it gives up – that in order to become a pre -trial detention, there must be a contemporary fact. But there is still only one document, which recognizes that it is mere ancient draft sent by a third party, besides the indeclinable find that such request has not materialized!”
The former president’s lawyers said it seems to be clear that the draft with an asylum request to Argentine President Javier Milei, dated February 2024, “cannot be considered an evidence of escape.”
“On the contrary, he obeyed all decisions issued by C. Supreme Court, including the prohibiting him from traveling abroad, responded to the complaint offered, attended all hearings, always respecting all the orders of this E. STF,” said the defense.
The former president’s manifestation of lawyers was a response to Moraes’s request for information to provide clarification on eventual breach of precautionary measures.
“It would be necessary to warn the Federal Police, especially the intelligence sector, that the criminal proceedings that originated the precautions was proposed a year later, and since then the former president has attended all his actions, including being at his residence when the use of an excellent anklet is determined,” he said.

“But the goal, let’s face it, has been achieved: headlines in Brazil and abroad announcing that the former president planned an escape. Nothing more false, but nothing more impactful, especially just over 10 days of trial,” the defense criticized, in reference to trial for attempted coup d’état to start September 2 at the STF.
Bolsonaro and federal deputy Eduardo Bolsonaro (PL-SP), his son, were indicted in a final report of the PF in investigations for attacks on the Supreme and attempted to interfere with the trial of proceedings for attempted coup by pressure from sanctions from the United States government.
In the 12-page demonstration, Bolsonaro’s lawyers call the PF report on a “political piece” in order to demoralize the former president, exposing his private life and accusing him of “as serious as he was unreasonable.”

“It sounds amazing, but much of the report is devoted to a told me-said without any relevance to the investigation,” he complained.
“Transcribes and replica dialogues that have no relationship with facts in investigation, after all it does not seem to be relevant to the investigation that the President wants to support Governor Tarcisio or one of his children as a presidential candidate,” the defense pointed out.
Lawyers require the revocation of house arrest imposed on Bolsonaro on August 4, by Moraes or the first class.
