Judge Antonio Maria Patiño Zorz, from the São Paulo Regional Electoral Court, tried on Monday (25) unfounded, Murillo Lima, Sergeant Nantes, Janaína Paschoal and Major Palumbo.
The action is filed by Councilman Paulo Frannge (MDB) and the parties Solidarity, PT, PV and PCdoB, who accuse the PP to defraud the gender quota. They accuse the party of launching 5 orange candidates from the 13 female in 2024.
For Judge Zorz, there was no fraud to the gender quota, however.
“Moreover, one has a woman candidate was elected by the Progressive Party (Janaina Conceição Paschoal), so he removed his mandate for alleged recognition of fraud at the gender quota would empty the ends of the norm,” wrote the judge.
The decision is first instance, and it is still possible to appeal.
Lawyer Márlon Reis, who represents France and the Brazil Federation of Hope, which brings together the PT, PCdoB and PV parties, says will appeal.
“We have done a detained analysis of the sentence and none of the arguments present there are sufficient to modify our understanding that there was a serious framework for fraud to laws,” says Reis. “It turns out that the PP took advantage of fictional candidates, simulating a board of women’s participation, but only three actually could count on the support of the association,” adds the lawyer.
The panel was unable to contact solidarity lawyers.
