The director general of, Andrei Rodrigues, suggested on Tuesday (26) to the minister the entry of a team of police inside the house of former president () for surveillance 24 hours.
In a letter sent to (Supreme Federal Court), the PF head said this is the best way to ensure that Bolsonaro will not try to escape the eve of his trial by the coup plot.
“As an alternative to this measure, and a way of ensuring the effectiveness of the measure (maintenance of house arrest) would be imperative to determine a police team to remain 24 hours inside the residence, as there are precedents,” says Andrei.
The letter was sent as a response to the decision of Moraes that determined the full time stay of agents of the Federal District Penal Police near Bolsonaro’s house, to prevent any attempted escape.
The minister says that the measure should be adopted to “avoid improper exposure, abstaining from any and all indiscretion, including media, without adopting intrusive measures of the defendant’s home sphere or disturbing neighborhood.”
Andrei told the Supreme that the measure is insufficient to prevent possible escape attempts. The director of the Federal Police highlights two main points.
The first is that the electronic anklet worn by Bolsonaro works online and depends on a signal from the telephone operator to issue the defendant’s movement signs.
“In these cases, the violations would only be informed by reporting to the system operators after the return of the signal, would allow it time for the custodian to undertake an escape,” he says.
The federal police chief also says that it would be necessary to monitor all the flow of vehicles at the residence of Bolsonaro and nearby neighbors to ensure that the running overdraft would be effective.
“This action, to ensure effectiveness, would require a thorough inspection, for example, of all vehicles that came out of the condominium, which could generate great discomfort, in contrast to what the PGR proposes,” he adds.
According to Andrei, there is a precedent that allows the permanence of 24 hours police in the house of defendants in house arrest. The director lifted only one case, that of retired judge Nicolau dos Santos Neto. In 2004, by order of the STJ (Superior Court of Justice), he was under house arrest under the custody of the PF.
The head of the PF concluded his demonstration to the Supreme stating that he had already defined with the Federal Penal Police who monitors together.
Minutes after Andrei Rodrigues sent the document, Minister Alexandre de Moraes sent the case for analysis by PGR (Attorney General’s Office). No deadline for the manifestation of Attorney General Paulo Gonet was not defined.
