The proposal provides for obligations to suppliers and access control by parents and guardians. Rules
Among other points, the project requires that information technology suppliers and services suppliers to adopt measures to prevent children and adolescent access to harmful content such as pornography, bullying, suicide incentive and gambling. The requirements will be proportional to the degree of control that suppliers exert on the content available in their applications. A later regulation, prepared by the Executive, will define objective criteria for this evaluation.
Companies with editorial control, such as newspapers, magazines, and licensed content providers, may be exempt from obligations if rules are followed by indicative classification, parental mediation and complaint channels. The rules apply to both services focused directly on children and youth and those with probable access by this public.
Freedom of expression
Regulation may not impose massive, generic or indiscriminate surveillance mechanisms; And practices will be prohibited that compromise the fundamental rights to freedom of expression, privacy, full protection and differentiated treatment of personal data of children and adolescents.
