Daniel Silveira’s progression to the open regime was scheduled for December 15, but by defense calculations, it could be anticipated

The defense of the former federal deputy asked the Federal Supreme Court () the progression of semi-open regime to open, claiming that he is entitled to 113 days of redemption of sentences for readings, courses and work performed at the Magé Penitentiary (RJ). The request will be reviewed by Minister Alexandre de Moraes, rapporteur of the case. According to lawyers Michael Pinheiro and Paulo César de Faria, Silveira read 12 classic works – among them Crime and punishment, The prince, Posthumous Memories of Brás Cubas, 1984 e The Animal Revolution – which would yield 48 days of the penalty of the penalty.

He also completed courses in the foundation of education and school accounting (15 days of redemption) and recorded 92 working days (30 days and two hours discount). The progression to the open regime was scheduled for December 15, but, by defense calculations, could be anticipated to August 23. The lawyers also requested that Silveira can stay overnight at home, alleging difficulties in daily travel to the prison unit due to postoperative treatment in the knee.

On the same day, the Attorney General’s Office () presented a favorable opinion on temporary exits for medical treatment, but rejected the request for conversion of the sentence into house arrest. The Deputy Attorney General, Hindenburg Chateaubriand Filho, said that the defense arguments about costs and difficulties of displacement “do not seem enough and are not supported by law.” He added that “discomfort is inherent in any displacement, not imposing itself as a sacrifice to any other right that the inmate eventually has.”

Silveira was authorized by Moraes to leave for physical therapy sessions for a month, using an electronic anklet and prior communication to the STF with each exit. The defense, however, asks the deadline to be extended to five months. Former military policeman and ally of former President Jair Bolsonaro, Daniel Silveira was convicted of the Supreme Court in 2022 to eight years and nine months in prison for threats to the Democratic Rule of Law and attempting to obstruct court investigations.
