The Environmental Crimes Law provides for a penalty of up to one year in prison for animal abuse

The horse that had his paws severed by a young man in the interior of São Paulo was alive before being mutilated. The information was released on Wednesday (27) by the delegate Rubens Luiz Fonseca Melo and the veterinarian Luana Gesualdi, who accompanied the investigations. In a video published on social networks, the delegate states that the inquiry was sent to the judiciary and the prosecutor.

“The report proves that the injuries were caused in life, the animal was still alive. I believe that by the ignorance of the one who did, and even the very drunkenness he said he was, he can believe he was dead.”

“The report is concluded: the horse was still alive when it suffered the blows. A case of cruelty, which reinforces the importance of joint work between veterinary expertise and police,” the veterinarian said.

The horse was buried last week, after she collected her the necessary material for the expertise. The author of the mutilation is Andrey Guilherme Nogueira de Queiroz, 21. On the 16th, he went to a ride riding this horse, along with a friend, who rode another animal.

The two traveled almost 15 kilometers in the countryside, most of them climbs, until the horse rode by Andrey stopped, in a region known as Serra do Guarana Hot, around 17h. Looking tired, the animal lay down and, according to Dalton, narrated the police, seemed to have difficulty breathing.

Andrey, who later told TV Vanguarda that she was drunk, claimed to believe the animal had died. At the time, he told Dalton, “If you have a heart, better not to look” and, with a machete, disappointed the horse’s paws. Then he still struck more blows against his horse while Dalton recorded the scene. Posted on social networks, the video went viral, generating much criticism of the Knight’s conduct, which came to the knowledge of the Environmental Military Police and the Civil Police.

The Environmental Crimes Act provides for up to one year in prison for animal abuse. If the animal dies, the penalty can be increased by up to one third – it would be a maximum of one year and four months in prison, therefore.

It was an act of disorder

In an interview with TV Vanguarda, on Tuesday (19), Andrey said she was drunk at the time of mutilation, and said she was sorry. “It was not a decision, it was an act of disorder (cutting the horse’s paws). In a drunk, upset, I took and cut by cutting. It was a cruel act. I had alcohol in my body. It’s not the fault of the drink. It’s my fault. I recognize my mistakes,” he said.

“Many people said that I cut all four and walking with him. This is a criticism against me. They are accusing me of an act that I did not do. Many people are judging me and saying that I am a monster. I am born and raised in the horse, I get the nickname cowboy,” he continued. “I’m totally sorry. I feel sorry for this cruelty I did,” concluded Andrey.
