The court of appeal in Rome has decided that the deputy (-SP) must wait in the prison, in closed regime, the processing of the process of his extradition from Italy to Brazil. The decision was communicated on Thursday (28) directly to lawyers.
At the hearing of Wednesday (27), he was hired by the Court to verify that the deputy state of health is compatible with his stay in jail.
Despite identifying diseases, depressive picture and hunger strike, the expert concluded that there are no elements that prevent Zambelli from continuing in jail. Since the end of July, she has been in Rome.
“Your therapeutic needs can all be met within the detention structure,” says the document, to which the Sheet had access.
In it, in addition to highlighting the result of the court’s nominated medical expertise, which concluded that their health is compatible with jail, the judges justify the maintenance of prison for the danger of new escape from Zambelli.
The court’s decision is contradicted by Zambelli’s defense, which asked for his transfer to house arrest with an electronic anklet, arguing that the congressman’s health conditions were incompatible with the chair.
With this defined stage, the analysis of the extradition request made by the Brazilian government may actually start.
In the coming weeks, the Public Prosecutor of Rome is expected to send a report on which he will comment on the case. Then, the court of appeal, equivalent to the first instance, will mark an audience to discuss whether or not there are requirements for Zambelli to be sent to Brazil.
Estimated between one and two years by experts, the processing may be faster with Zambelli in prison. According to Italian lawyer Alessandro Gentiloni, who represents Brazil in this case, the decision of the first instance may leave until the end of October.
Then, any resources will be analyzed by the cassation court, which, in the case of a detained person, can take between three and four months to decide. Finally, the Italian government, after the final decision of justice, has 45 days to give the last word about extradition.
Zambelli fled to Italy to escape the conviction of ten years in prison determined by the (Supreme Court). She was accused of participating in the invasion of the CNJ (National Council of Justice) system to issue a fake arrest warrant against the minister.
His defense in Italy, to avoid extradition, intends to demonstrate that the process has “anomalies”, such as the fact that “the victim of the alleged crime was the same person who made the sentence, who decided to execute the judgment and decided the appeal,” said lawyer Pieremilio Sammarco. Zambelli says he is a victim of political persecution in Brazil.
Last Friday (22), she was sentenced by the Supreme Court to another five years and three months in prison under another case, referring to the episode in which she drew and pointed a gun at the eve of the second round of the 2022 elections.
