Councilman Jair Renan Bolsonaro (PL) sought to ban the so -called ‘ideological indoctrination to communism, socialism and Nazism’

The Attorney General of the City Council (SC) issued an opinion contrary to the bill presented by the councilman (PL) that sought to ban the so-called “ideological indoctrination to communism, socialism and Nazism” in the schools of the municipality. According to the agency, the proposal is inadmissible because it is unconstitutional, as it invades the union’s competence to legislate on national education guidelines and violate principles such as freedom of chair, the pluralism of ideas and pedagogical autonomy.

The Prosecutor’s Office also pointed out that although the apology for Nazism is unlawful and not protected by freedom of expression – according to the understanding consolidated by the Supreme Court, which equates practice to racism and discourse of hatred – the extent of this prohibition to communism and socialism would be disproportionate and contrary to the Federal Constitution of 1988.

The project analyzed was a substitute version presented this month. The initial proposal, filed in May and already archived, had also been considered unconstitutional. It provided for the prohibition of the display of symbols and emblems linked to communism, socialism and Nazism in public or private spaces for collective use, such as the sickle and the hammer. In the opinion on the substitute text, the Attorney’s Office recommended that if the initiative advances, social participation is guaranteed through a public hearing and manifestation of the Municipal Education Council (Conseme).

In addition to this proposal, since the beginning of the term of office in 2025, the councilman has already submitted 25 nominations, nine motions, three requirements, three requests of information and another bill, filed in July, which prohibits hiring shows and events open to children who make an apology for organized crime or drug use.
