PEC DA BLINDAGE DIVIDES CENTRÃO AND UP TO REPORT – 28/08/2025 – POWER

The attempt to expand the PEC (proposal for amendment to the Constitution) of the armor with measures such as increasing the quorum for a complaint to be received against a parliamentarian divided the center, caused a chat in a meeting between the leaders of the parties and made even the rapporteur threatened not to sign the opinion in the face of divergences.

Among the initiatives included in this second version was to increase the quorum for a complaint to be accepted by the Supreme Court (STF) and begin to process. Currently, a majority of the board is necessary (6 votes in the plenary and 3 votes in the class). With the change, it would take 4 of the 5 votes in the class or 8 of the 11 ministers in the Plenary.

The proposal would be to match the receipt of a criminal complaint against a deputy or senator, in the Supreme Court, to the quorum necessary for the Congress to authorize the President of the Republic to be prosecuted or the target of impeachment.

In addition, the newly disqualified text locked the current inquiries in progress until there was ahead of the legislature, allowing Congress to politically reject the arrest of a parliamentarian and to decide every 90 days if he should remain arrested-which could only occur in the face of act for nonsense crime.

The proposal gained support from the Centrão parties and also the opposition, but was questioned by the leftist deputies. Deputies are divided over whether the postponement will lead to a temporary filing of the proposal or if the theme will be discussed again next week. Even the left members say that the discussion of prerogatives, as not being processed by their words and discourses, is a sensitive and appeal in the plenary. The radical text, however, is considered buried and without majority.

PEC emerged as part of a negotiation led by former mayor Arthur Lira (PP-AL), PP leader Dr Luizinho Teixeira (RJ), and Deputy Elmar Nascimento (União Brasil-BA) to suspend the riots of the pockets, who prevented Motta from charging the sessions to charge the former president’s amnesty (PL).

If MDB and PSD join the leftist parties against PEC, approving the text will be much more difficult, in the evaluation of parliamentarians. Together, these parties would reach 214 deputies, which would make only 299 votes in other subtitles remain less than the 308 necessary. But the result is uncertain, even so, because there are disagreements within almost all parties.

Another reason for postponement, on Wednesday, was the lack of quorum for a controversial deliberation and late at night. When the session ended, more than 10 pm, only 469 of the 513 deputies had been present, which made it more complicated to reach 308 votes of approval.

Deputies also want to combine with senators the elaboration of a consensus text, which can be approved quickly between the two houses to prevent the delay from raising the tone of society’s criticism.

The non-vote by PEC adds to the series of setbacks for Motta, which decided to guide the text to Wednesday and stated in interviews that most of the house was favorable. In the morning, he had stated that discussing prerogatives was a congressional right and a priority, as it would bring more independence.

“It serves the spirit of the house. There are several parties, not only opposition parties or allied base, a feeling in the house that this parliamentary activity needs to be, I will not say better protected, but better sized from a legal point of view,” he said at an event promoted by Grupo Globo.

Some deputies criticize the president and they understood to be a flaw of articulation or at least communication, for leading to the discussion of leaders a different text than what had been agreed between benches and lafayette.
