It was scheduled for September 16, at 2 pm, the trial of the appeal that could take the former president of Vale Fábio Schvartsman back to the criminal case over the tragedy of Brumadinho, who killed nearly 300 people in 2019. The special appeal was filed by the Federal Prosecutor (MPF) and will be tried by the 6th Panel of the Superior Court of Justice (STJ), the Association of Family Family (Avabrum) said.
The trial of the lawsuit was marked by Minister Sebastião Reis Júnior, rapporteur of the case in the STJ. The session will feature the participation and vote of four other judges, components of the 6th class, according to Avabrum, and will be transmitted by YouTube.
According to the association’s lawyer, Danilo Chammas, “since the decision of the 2nd Panel of the Federal Regional Court of the 6th Region (TRF-6) came out, we have argued that it was wrong. We have no doubt that there have always been enough elements for Fábio Schvartsman to respond for his crimes, along with all other defendants. We will follow this trial with hope,” said Chammas in a statement, 28.

Avabrum President Maria Regina Silva, who lost her daughter in the breaking of the dam on January 25, 2019, stressed the absurdity of Schvartsman’s name came out of the process. “All defendants have to go through the process, otherwise we can give up the justice system. It was not any crime. The victims have been crushed, the association will continue to follow each step of criminal actions and charging for justice, because impunity makes the crime recurring,” said Silva.
The breaking of the Mine Dam Córrego do Feijão, Vale, in Brumadinho, killed 272 people, the last victim found almost two years later, in 2022, such was the difficulty of the identification process.
In February 2020, by decision of the Judge of Brumadinho, the former president of Vale became a defendant, along with 15 other individuals and two companies, on charges of doubly qualified intentional homicide crimes and environmental crimes.

In March 2024, the 2nd TRF6 Panel decided to lock criminal actions regarding Fábio Schvartsman, former president of Vale, when accepting a habeas corpus presented by his defense. Given this decision, the MPF filed a special appeal, which was subscribed by the Regional Prosecutor, Darlan Airton Dias.
