The number, amplitude and content of the investigations under the command of Minister Alexandre de Moraes, of the Supreme Court (STF), remains unknown on the eve of the most important judgment in the political world in 2025.
The Court judges from Tuesday (2) the first nucleus of the complaint of the coup plot of 2022 and 2023, whose leadership was attributed to Jair Bolsonaro (PL).
He is accused by the PGR of committing crimes of armed criminal organization, violent abolition of the Democratic Rule of Law and coup d’état, as well as qualified damage and deterioration of overturned assets. Bolsonaro denies having committed any irregularity. The action has Moraes as a rapporteur.
Not to mention this action and the processes related to the scammer acts of January 8, 2023, it is possible to know that there are at least 150 public procedures or with a low degree of secret to investigations into digital militias and attacks on institutions.
This account may be found on the STF’s open cut platform, but it does not include the confidentiality procedures under the minister’s rapporteur.
Moraes became the rapporteur of the call in 2019. He was chosen for the atypical position by the then President of the Court, Minister Dias Toffoli,
Since then, Moraes has authorized the opening of hundreds of procedures involving various targets. He became responsible for the investigations dealing with January 8, the coup plot after the defeat of to Lula (PT) in the 2022 elections and the investigation into, among others.
Each investigation has a branch of confidential procedures, and part of them came public at some point by other means.
This happened, for example, last July, revealed orders from the Minister of Suspension of Profiles on Social Networks that did not go through the Attorney General’s Office) or the Federal Police.
The report once again questioned the Court and the PGR (Attorney General of the Republic) this week about the number of procedures and inquiries from fake news investigations, undemocratic acts and digital militias.
The STF indicated the open court, but did not respond to the number of confidential processes. PGR did not speak up.
Moraes currently has three major “umbrella inquiries” in his hands. Two of them remain under high degree of high confidentiality and with physical version: Fake News and undemocratic acts – this is the second inquiry with that name, as the first of them was filed in 2021.
In addition to them, there is also the digital militia inquiry. In this case, the main records are public, but there is confidentiality about a significant portion of procedures related to it.
The numerous open procedures contribute to investigations not to reach an end. Even if the main aspect of the inquiry is filed, the other branches remain underway and with Moraes as a rapporteur.
Currently there is no forecast for these investigations to end. In August last year, the president of the Supreme, Luís Roberto Barroso, said in an interview with Sheet that.
“I think we are not far from closing because the Attorney General is already receiving the material. It will be up to him to ask or make the complaint,” he said.
Four months after the statement, Barroso indicated a change of evaluation. “The inquiry is taking too long because the facts have multiplied over time,” he said.
One of the reasons for investigating dragging is the sanctions that Donald Trump government in the United States has applied to the Supreme members and the articulations made by the deputy (-SP) against the court. They gave rise to new investigations and procedures.
Inquiries
The digital militias survey was opened by the Supreme Court on the same day of July 2021 in which Moraes ended the inquiry of undemocratic acts. The research focuses on the emergence of a criminal organization of digital action and with separate nuclei for production, publication, financing and political use of misinformation to pay against democracy.
The scope of the investigation is similar to another Supreme Inquiry in 2019 to investigate the dissemination of fake news. The so -called fake news inquiry, however, has a scope more restricted to attacks on the Supreme and his ministers.
The object of the investigation into digital militias has grown. He began aiming at an allied core of then -President Jair Bolsonaro, and was expanded to other targets.
