Minister Alexandre de Moraes of the Federal Supreme Court (STF) determined on Saturday, 30, new restrictions on the house arrest of Jair Bolsonaro (PL). The decision authorizes the Federal District Criminal Police to inspect all vehicles leaving the former president’s residence and imposes on-person monitoring outside the House, after alerts from the Federal Police and the Penitentiary Administration Secretariat on escape risk and failures in electronic screening.

On Monday, 25, the Attorney General of the Republic, Paulo Gonet, defended in the Supreme a reinforcement in Bolsonaro surveillance, citing the risk of escape from the former president. PGR assessed that there could be expansion of house arrest monitoring, especially outside the house using cameras, but ruled out the need for permanent presence of agents within the property – proposal raised by the Federal Police, which defended that it was indispensable “the full time monitoring of activities” to prevent an eventual escape.

Moraes’s decision this Saturday came on the wake of this debate. The minister determined that the former president be monitored full-time and authorized the Federal District Penal Police to conduct “surveys in the dwellings and trunk of all vehicles leaving the defendant’s residence”, with a daily registration of cars, drivers and passengers.

The minister also ordered “face -to -face monitoring outside the residence (…) due to the higher exposure to the risk referred to by the police authority”, given the existence of blind points in the property.

In the decision, Moraes stressed that house arrest “remains a kind of restriction on individual freedom, not losing the characteristics of partial restriction of privacy and intimacy of the custodian, under penalty of its total uselessness.” According to him, the adoption of new measures seeks to reconcile the guarantee of criminal law with the preservation of privacy of other residents.

External monitoring was requested by the Federal District Penitentiary Administration Secretariat, which pointed to the existence of “blind points” on the ground, as Bolsonaro’s house is neighboring other properties on the sides and backgrounds.

The organ also reported technical limitations of the electronic anklet, such as failures in areas without signal coverage and even the possibility of blocking or “aluminum paper envelope” – factors that reinforced the need for surveillance.
