Few situations are as stressful as receiving a letter of dismissal. After years of working for a company, the news can come abruptly and leave anyone without knowing how to react.
When the dismissal happens
There are several reasons that can lead an employer to terminate contract: budget cuts, internal reorganization or, in some cases, alleged misconduct. Regardless of the reason, the impact is always hard for the worker.
At these times, the natural reaction can be of revolt or frustration. Many people choose to cut ties immediately, erasing messages and leaving working groups. However, and according to the Spanish newspaper, experts ensure that this attitude can be harmful.
It was precisely this warning that Laboalist lawyer Juanma Lorente shared through his Tiktok account, where he explained what essential precautions to take at the time of a dismissal.
The most common error
According to Lorente, “never delete conversations with your boss.” The lawyer recalls that workers are often taken by Zanga, delete messages or abandoning Whatsapp groups linked to the company.
For the expert, this emotional reaction may compromise the defense of worker rights in court. “In conversations with your bosses and in groups with colleagues there are many of the evidence that can help you gain a process,” he explained.
These messages may reveal, for example, the true reason for dismissal, unpaid overtime or other irregularities in working conditions.
Evidence that can make a difference
By keeping these conversations stored, the worker has a solid basis of elements that can be presented in court. “If you don’t erase these conversations, we start from a much better point,” says the lawyer.
In practice, a simple history of messaging may be sufficient to demonstrate inconsistencies or abusive practices by the company. This is why the recommendation is clear: this type of information should never be eliminated.
In addition to WhatsApp, the same rule applies to other messaging or email applications. All communications may be relevant in a judicial process.
The importance of thinking in the long run
For Lorente, acting hot head is the biggest mistake a worker can make when fired. “When things get complicated, they will thank you to have these conversations,” he said.
The lawyer recalls that, in many situations, it is the documentary proof itself that allows the worker to contest the dismissal or claim fairer compensation.
Without these records, the hypotheses of success in court decrease significantly, as it is only the word of one part against that of the other.
Defend labor rights
According to, the message left by the expert is clear: keeping evidence can be decisive in enforcing worker rights. In the case of unjustified dismissals, it may even mean the difference between losing or gaining a lawsuit.
More and more courts accept this type of documents as valid evidence, provided they are presented legitimately and without manipulation.
In the end, maintaining conversations and work-related messages costs nothing and can become the most effective weapon when facing a work process.
