Proposal of Sostenes Cavalcante retroage until 2019, beginning of fake news inquiry, and rehabilitates former president for the elections; Text must find resistance in Congress

The leader of the House, Deputy (RJ), said that the amnesty proposal to those involved in the acts of – which can also benefit – will not be discussed or voted next week. The announcement occurs on the eve of the resumption of the trial of the former president and other defendants in the first class of the Supreme Federal Court (STF), scheduled for Tuesday (9), Wednesday (10) and Friday (12). According to Sostenes, the mayor, (Republicans-PB), ensured that the proposal will be based, but without indicating a deadline. “Next week will be nothing. It will be a quieter week to make the dialogues,” said the deputy, after meeting at the official residence of the house.

Sostenes has elaborated an amnesty text that is considered the most comprehensive so far. The proposal retroacts until March 2019, beginning of the fake news inquiry, and grants forgiveness to investigated, processed and convicted of crimes related to attacks on institutions, incitement to crime, criminal association and electoral illicit, among others. The text also overthrows all ineligibilities already applied or being declared, which would rehabilitate Bolsonaro to compete in the 2026 elections.

A similar version circulates in the House with the signing of (Union), rapporteur of the theme in the Constitution and Justice Commission. Both projects contrast with the strategy of the center, which defends the amnesty, but without contemplating Bolsonaro, in an articulation to strengthen the governor of São Paulo (Republicans), as a presidential alternative.

The PL leader said he believed that the rapporteur will be chosen between center-right parties, such as, or, and ruled out the possibility that the PL assumes this function. He also accused ministers of pressuring Congress: “Some want to hand over Bolsonaro’s prison as a trophy.” In the Senate, the process also promises disputes. The president of the house, David Alcolumbre (Union-AP), has already spoken in favor of a restricted version of the amnesty, without benefiting Bolsonaro. The posture was classified as “strange” by Sostenes, who charged neutrality.

The federal government and jurists question the constitutionality of the project. PT’s deputy leader in the House, Deputy Alencar Santana (SP), classified the proposal as “an attack on the Constitution”. For experts, if passed, the law must be challenged in the Supreme, as the Constitution considers crimes against the democratic rule of imprescriptible and unenforceable law. The president also expressed concern. In an event in Minas Gerais, he warned of the “strength of the far right” in Congress and the risk of amnesty approval.
