The recent proposal for a change in has generated intense debates in the Brazilian political scenario. The proposed change aims to change the counting of the time of ineligibility to revoked politicians, starting the period of eight years from the loss of the mandate, resignation or conviction in the second instance. Currently, the decision on the sanction or veto of the law is in the hands of the president. However, experts claim that the project may be contested in the Federal Supreme Court ().

Márlon Reis, one of the creators of the Clean Record Law, expressed his concern with the proposed changes, classifying them as unconstitutional. Reis promised to resort to the Supreme Court if the law is sanctioned, arguing that the change represents a significant setback. He pointed out that the new ineligibility time count could allow condemned politicians to return to the electoral scenario faster, which contradicts the original purpose of the law to rule out candidates with a history of irregularities.

Lawyer Francisco Ronei de Souza, a specialist in Electoral Law, also criticized the proposal, considering it a watershed for the 2026 elections. He and other critics, such as senators Castro and Eduardo Girão, fear that the change weakens the Clean Record Law, which was created to ensure that politicians with a history of corruption are removed by at least two elections. The proposal also establishes a maximum period of 12 years for ineligibility, even in cases of successive convictions, which, according to critics, distorts the original purpose of the legislation.
