Moraes denies arrest of PMDF Colonel Defendant for 8/1, but warns

The Federal Supreme Court Minister () Alexandre de Moraes denied, on Monday (8/9), the request for preventive arrest of the Colonel of the Federal District Military Police (PMDF), defendant in the process of the undemocratic acts of 8 January.

In the decision, Moraes warned the colonel and said he could decree his arrest if there is a breach of precautionary measures imposed on the defendant.

“Therefore, I fail to convert the precautionary measures into pre -trial detention, warning the defendant, however, that if non -compliance the conversion will be immediate,” wrote Moraes.

The decision responds to the request submitted by the National Federation of State Military Squares Entities (Fenepe), which he pointed out.

Fenepe claimed that the defendant’s wife, Mariana Naime, gave online interviews of the house where she resides with her husband. At the time, Mariana Naime addressed a person who called the “advisor.” According to the entity, this person would be Naime, who would have positioned himself behind the cameras to pass on information to her.

“Although the videos of the interviews granted by the defendant’s wife suggested that she interact with someone, there is no direct proof of the identity of Jorge Eduardo Barreto Naime as his interlocutor. The lack of quality and sharpness of the audio and direct vision of the interlocutor prevents the breach of precautionary measures by the defendant. Even if the precautionary measure imposed on the defendant may be violated by via via the intermediary Third parties, there is, in this case, concrete proof of violation, ”said Moraes.

Naime is one of the former PMDF summit at the time of non-democratic acts of January 8. See who the defendants are:

  • Colonel Fábio Augusto Vieira, then Commander General of the PMDF on January 8, 2023;
  • Colonel Klepter Rosa Gonçalves, then Deputy Commander General;
  • Colonel Jorge Eduardo Barreto Naime, former chief of the Operations Department;
  • Colonel Paulo José Ferreira de Sousa Bezerra, head of operations in office;
  • Colonel Marcelo Casimiro Vasconcelos;
  • Major Flávio Silvestre de Alencar; and
  • Lieutenant Rafael Pereira Martins.
