The minister voted with the majority of the (Supreme Federal Court) in August 2012, during the judgment of the Court’s jurisdiction to analyze cases of defendants without privileged forum.
The stance contrasts with his in which he defended the nullity of the process by assessing that cases should be considered by the first instance.
13 years ago, the ministers leaned over lawyer Márcio Thomaz Bastos that his client, the former executive of Rural Bank José Roberto Salgado, and other defendants without forum, had the process dismembered and sent to lower courts.
There were 9 votes against Bastos’s request, including Fux’s. Only the demand accepted the then Minister Ricardo Lewandowski and Marco Aurélio Mello.
