TCE maintains suspension of selection process for civic-military school in SP

The Court of Auditors of the State of São Paulo (TCE-SP) denied the reconsideration request submitted by the Secretariat of Education and maintained the suspension of the notice and the selection process for hiring monitors of the Civic-Military School Program, of the Tarcísio de Freitas Government (Republicans).

With the decision, the selection of reserve military personnel that would be hired to work in the program follows. The disclosure of the approved list was scheduled for the last day 4.

The decision was made after representation presented by the Collective Education in 1st place, formed by Federal Deputy Professor Luciene Cavalcante (PSOL), State Representative Carlos Giannazi (PSOL) and Councilman Celso Giannazi (PSOL).

The ECA pointed out problems such as absence of budget forecast, temporary hiring without justification of exceptionality, lack of public tender and creation of commissioned positions. THE CNN tries to contact the São Paulo government about the decision.

Approval and suspension

In May 2024, the project was approved by the São Paulo State Legislative Assembly (Alesp), focusing on the creation of schools with “shared management” between military corporations and state or municipal education secretariats.

With the division, the military are responsible for “administration and citizenship”. The goal is to raise the Basic Education Development Index (IDEB) in school units and insert citizenship activities into the students’ routine.

In approval, the session was turbulent, using police force to stop protesters, beaten students and arrests, amid protests against the program. One of the party’s arguments is that the program establishes a “true project of militarization of the civil school”.

In the same month of last year, the São Paulo State Official Teachers Union (Apeoesp) filed a lawsuit at the TJSP against Alesp President André Prado (PL), also pointing unconstitutionality and requesting the suspension of the Tarcisio program.

In August, the court ordered immediate suspension of the project until the Direct Unconstitutionality Action (ADI) on the program was analyzed by the Federal Supreme Court (STF). In November, Minister Gilmar Mendes revoked the TJSP decision.

In the suspension of the ECA, the rapporteur stressed that it is not up to the Court to judge the constitutionality of the law that established the program. Judgment is restricted to the control of administrative, budgetary and financial legality of the acts of the Executive Power.
