Fux says Bolsonaro attacks on the polls do not constitute a crime against democracy

Minister Luiz Fux of the Federal Supreme Court (STF) said on Wednesday (10) that speeches and interviews by former President Jair Bolsonaro (PL) questioning the electronic voting system cannot be framed as an attempt to abolish the Democratic Rule of Law.

In his vote, Fux stressed that criminal law requires the presence of violence or serious threat to configure the crime provided for in Article 359-L of the Penal Code.

“It cannot be assumed that they can configure attempted abolition of the Democratic Rule of Law speeches or interviews, even if they contain questions against the regularity of the voting system or rude accusations against members of other powers,” he said.

The minister specifically cited Live of July 29, 2021, the interview given to the Pingos Nos program on August 4, 2021, and speech at institutional meetings of July 5 and 18, 2022. For him, none of these episodes met the violence requirement provided for by law.

“This is why I consider criminal typicality to these speeches,” Fux concluded, dismissing another accusation made by the Attorney General’s Office (PGR) against the former president.
