Minister Luiz Fux said on Wednesday (10) that there is no evidence that Jair Bolsonaro (PL) has ordered or not even became aware of scammer plans such as Operation Cup 2022 and the green and yellow dagger.
The two initiatives, revealed in messages from military personnel linked to the former president, involved the monitoring of authorities and even the forecast of murders.
According to Fux, messages between Marcelo Câmara and Mauro Cid show no science or participation of Bolsonaro. Cid himself, in award -winning denunciation, stated that the orders to monitor Minister Alexandre de Moraes departed from Rafael Martins de Oliveira and Hélio Ferreira Lima, pointed out as leaders of Operation Cup 2022.
“Most important for the analysis is to realize that there is no proof that denotes the science or contribution of the defendant Jair Bolsonaro in the group Copa 2022, as well as there are no elements to the detriment of the accused regarding the planning and yellow daggers. Therefore, which is necessary to dismiss the accusatory claim as well as to these facts,” said Fux.
Failures in the prosecution
The magistrate also pointed out that there are no elements that prove that Bolsonaro had access to the green and yellow dagger plan, which provided for the death of Moraes, President Luiz Inacio Lula da Silva and vice-president Geraldo Alckmin.
“There is no element that identifies the former president’s science about the draft Green and Yellow Plan,” Fux said, adding that the accusation has no evidence of the former president’s consent.

The minister classified as fragile and contradictory the accusations against Bolsonaro:
“These contradictions and flaws that, in my way of seeing, are intrinsically in the accusation, will become unsustainable as the narrative advances. And so far, as noted, there is no evidence that sustains a condemnatory edict. The condemnatory edict has to bring peace of mind to the judge in condemning.”
With this position, Fux reinforces his tendency to vote for Bolsonaro’s acquittal in some of the main points of the Attorney General’s complaint.
