A fortune of 5 million euros is at the center of a legal dispute in Italy, after an 87 -year -old elderly woman left her inheritance to the maid and caregiver to the detriment of the eight grandchildren. The case raised suspicions of handling and led the prosecutor to impute the employee and ordered the preventive embargo of the entire inheritance until the final decision of the court.
Anna Malfati, an 87 -year -old Italian retired, decided in 2022 to change her will. He appeared before a notary and declared his intention to leave all heritage to his caregiver, with whom he shared the last years of life.
According to the defense, the document was signed with all legal guarantees and was even registered on video, where you can see the old lucid to sign and correct the notary when she misses the name of the beneficiary, according to the digital newspaper Spanish noticias work.
A video will
A month later, the same caregiver still obtained a notarial power, reinforcing the confidence that the baroness put it on it. Although the work bond was no longer formally in force, the woman continued to follow Malfati on a daily basis. “She lay her every night, by Mrs. Malfatti’s express desire,” explained the defense lawyer.
The inheritance in question included one million euros in cash and six apartments spread across Italy, jointly evaluated at 5 million euros. Despite the high amount, the caregiver chose not to immediately complain about the fortune, preferring to wait for the decision of justice about the validity of the will.
Family reaction
The eight grandchildren of the elderly did not accept the decision and appealed to the courts. They argued that their grandmother was not in mental conditions to change the will and accused the caregiver of “taking advantage of the octogenarian’s cognitive deterioration” to stay with all the goods, according to the same source.
In support of their position, they presented a psychiatric report that described signs of severe mental deterioration since November 2023, months before the death of the elderly. This document became the heirs’s main argument to try to nullify the last will of the grandmother.
Prosecution
In the face of the dispute, the Rovereto Attorney’s Office imputed to the maid the crime of manipulating a vulnerable person. The preventive embargo of the entire inheritance was also decreed until the case is resolved in court.
The caregiver’s lawyer defended himself, rejecting the accusations and underlining the close connection between the two. “In civil action there is talk of family lineage and tradition, as if my client had nothing meaning to the baroness,” he said, adding, according to the same source, that such an argument “lets in a racist, albeit unconscious component.”
Decisive role in the video
According to the defense, the video recorded at the time of the will will be decisive, as it shows conscious, attentive and firm Malfati, including the notary during the signature. For the lawyer, this record proves that the elderly’s will was clear and unambiguous.
Now, according to, it is up to the court to decide whether to prevail Anna Malfati’s last will or whether the grandchildren can annul the will and recover the inheritance that continues under court dispute.
