House of Representatives approves of amnesty project to convicts of January 8

Decision was supported by 311 to 163 contrary; agenda was placed in voting by the president of the house, Hugo Motta, who stated that the final text and scope of the amnesty will still be discussed

In defense of the Amnesty PL, Deputy Gustavo Gayer of the Liberal Party (PL) spoke excitedly, stating that the moment can “mark the history of our country” and be “a light at the end of the tunnel of a very dark period.” Gayer mentioned the suffering of “hundreds of families and thousands of Brazilians” and the situation of prisoners he has classified as “illegally political prisoners.”

“That’s why today I am proud to come here in this microphone on behalf of the whole PL, every Brazilian, every Christian, everyone who wants to see a free nation. President, PL advises yes,” he said, being applauded then. On the other hand, the PT leader in the House, Deputy Lindbergh Farias, guided the vote against urgency, lamenting the agenda and alerting to the risks. Farias argued that the amnesty proposed, coming from Senator Marcelo Crivella, is “wide, general and unrestricted” and covers electoral crimes. He warned that the approval of the urgency, which requires 257 votes, would open the “gate” so that the amnesty project would be approved with a simple majority later.

Lindbergh Farias recalled a series of events, from systematic attacks to the electronic ballot box to the scam and acts of 8 January, classifying them as a “climbing against democracy.” He mentioned a “murder plan of President Lula, Vice President Alckmin and Alexandre de Moraes” and questioned the intention of pacification. “Does anyone here believe that they want to pacify something?” He teased.

The reduction of penalty, by favoring the accused, would be more easily applied by the criminal execution law, even benefiting those already convicted. Silveira points out that this “light Amnesty” would bring less problems for STF decisions, but would still generate complexity in the execution of the penalty. The vote on the urgency of the Amnesty PL continues in the House, with party leaders guiding their benches amid a scenario of intense polarization and legal discussions about the limits of forgiveness and justice.
