The federal deputy (União Brasil-SP) filed a writ of mandamus in the Supreme on Tuesday (18). This type of action tries to protect rights threatened by a public authority.
Kataguiri argues that the proposal approved by the House has four affronts to the Constitution. The main ones are the widening of the special forum, extending it to party presidents, and the armor of parliamentarians against civil processes.
“Using the exercise of the political party presidency as a criterion for forum by prerogative of function means giving powers to a private law entity, of associative character, to decide who will be judged by the Supreme Court. This is a clear and direct affront to equality,” says the deputy.
The parliamentarian also asks the Supreme Court to decide, urgently, to prevent the shielding of the armor until the Court discusses the merits of the issues raised in the action.
The shielding PEC was approved by the House on Tuesday (16). The text provides that investigations against parliamentarians can only be opened in the Supreme Court upon approval of deputies and senators, in a secret vote.
The proposal is in the Senate, and President David Alcolumbre (Brazil-AP Union) indicated to party leaders that he should not speed up the PEC.
