STF calls’ unfair ‘sanction to Moraes’ wife, and minister classifies a measure as’ illegal’

The Federal Supreme Court () published a note, on Monday (22), a few hours after the government sanctioned the minister’s wife, in which he says regret and consider “unjust” the new financial measure imposed by the United States against members of the Brazilian judiciary and their families. Lawyer Viviane Barci de Moraes and the Lex Institute, owned by the Moraes family, were sanctioned with the magnitsky law, even a device used against her husband.

The court states that “unfortunately, US authorities were convinced of a narrative that does not correspond to the facts.” Following, the note mentions that the “almost all of society recognizes the historical importance” of the trial that condemned former President Jair Bolsonaro (PL) by paying attention to democracy.

“We are facing a trial that respected due process and the broad right of defense, with total publicity,” said the Supreme Court. The text was not signed by the president of the Supreme Court, Luís Roberto Barroso, which reflects a high degree of institutionality and support from the whole Court to Moraes and his family at this time.

The note ends up reinforcing the sense of injustice in the court, saying that the expansion of financial sanctions to a family member of Moraes is even more unfair. The Supreme Court argues that Moraes has had “independent action and within the laws and the Constitution”.

Moraes also spoke in a statement and called illegal and unfortunate the sanction imposed against his wife. The minister stated that the application of the legal provision contrasts with the history of the United States and “violent international law, the sovereignty of Brazil and the independence of the judiciary.”

“Independence of the judiciary, institutional courage and defense to national sovereignty are part of the republican universe of Brazilian judges, who will not accept coercions or obstructions in the exercise of their constitutional mission sovereignly conferred by the Brazilian people,” he continued. The magistrate finished the note with the statement that he will continue to judge independently and bias.
