The Donald Trump government included the wife of Minister Alexandre de Moraes of the Supreme Court (STF), Viviane Barci, on the list of sanctioned by the magnistky law, along with her husband.
The punishment was extended to her after pockets pointed out that Viviane would be an important financial arm of the family.
The inclusion was made during a trip by President Lula (PT) to New York to participate in the UN General Assembly (United Nations Organizations), imposing an embarrassment to the Brazilian delegation.
The tendency is for Lula to respond to Trump during a speech in the assembly debate on Tuesday (23). Brazil is the first to speak, followed by the US.
She is a partner in a law firm and one of the owners, along with her children, from the Lex Institute of Legal Studies, a family entity founded by Moraes in 2000, but then passed on to family control.
The institute owns 11 properties, one of them being the residence of Moraes in São Paulo, and was also included in the list of sanctions of the magnistky law.
In August, Deputy Eduardo Bolsonaro (PL-SP) told Folha de S.Paulo that he had perception of the Donald Trump government that sanctioning Moraes without including Viviane would be counterproductive. He described it at the time as the “financial arm” of the STF magistrate. The motivation would be that part of the couple’s performance is the result of her performance as a lawyer.
“This can occur [a sanção a Viviane]. As is well known, relatives’ law firms are mapped and can be sanctioned depending on how authorities react, ”said Eduardo at the time.
Moraes was sanctioned in August with the magnistky law, Norma is used to punish those who commit serious human rights violations and has been used against dictators in the past.
The Secretary of State, Marco Rubio, states that Moraes has committed abuse by authorizing unjust preventive arrests and making decisions that, according to him, undermine freedom of expression.
The magnistky law provides that it can be included in the list of sanctioned those who collaborate with US condemned conduct.
The punished person receives a sanction from OFAC, a foreign asset control office, which belongs to the US Treasury Department.
Through the decision, the US government determines the freezing of any good or asset that the sanctioned person has in the United States and may also ban US financial entities from doing dollar operations with them.
The measure would include the use of MasterCard and Visa credit card flags, for example. The effects on Moraes’ transactions in reais in Brazil are still under bank analysis.
