Data Centers sector reacts optimistic to MP stimuli and awaits detail

The date of the date centers and suppliers received with optimism the publication last week of the Provisional Measure (MP) that regulates and establishes stimuli to the segment. Under the expectation of regulations detailing the regulation, the decision confirms the potential of Brazil to accept the growing demand for storage and computational power.

By the proposal sent to the Congress analysis, the Government created the Special Taxation Regime for Datacenter Services (Redata), modifying the previous legislation dealing with taxes to technology companies. The expectation of the government is that the regulation will unlock $ 2 trillion in the next decade.

One of the main claims of the sector with the Ministry of Finance and the Ministry of Development, Industry, Commerce and Services was the tax exemption of equipment without national similarity to data centers developers, included in the MP. Sources in the sector still await, however, the details of which equipment should be exempt.

A spokesman for the Brazilian Data Center Association (ABDC) told the Infomoney That the next step is to gain granularity in implementation, especially with regard to the accreditation process and the regulatory scope. The sector awaits, for example, explanations on the impact of regulation on different value chain agents.

The director of the Enterprise Division of Nvidia () for Latin America, Marcio Aguiar, evaluates MP’s sending to Congress as a “significant advance for the ecosystem”. According to him, the company, the main supplier of the GPUs – processors that support the demand of the data centers – sees the measure as an incentive that could benefit partners, customers and the entire ecosystem, but states that it is not up to the company to detail the tax application of each specific product.

Since the explosion of generative artificial intelligence models has stimulated demand for computing, the sector seeks alternatives to ensure its ability to create infrastructure. Negotiations to implement tax reform to attract investments faster.

The regime comes into force on January 1, 2026 and will be integrated into the tax reform in 2027. Exemption should improve operating costs in a context of historically low vacancy rates on high -leased data centers and rental prices – especially in large cities like São Paulo.

In contrast to the exemptions, companies qualified for the benefit should invest 2% of the value of equipment purchased in research and development and innovation, allocating at least 10% of the domestic market capacity and meeting sustainability criteria such as the use of 100% renewable energy and carbon neutrality. The government estimates that 60% of Brazil data today is stored abroad.
