The rapporteur of the penalty reduction project for involved in January 8 and the coup plot, deputy (Solidarity-SP), consistent changes in his idea of text to wipe the proposal and make the benefit to those who attached democracy, in a left wave, with an impasse, with PT and contrary to the measure.
On Tuesday (23), Paulinho again stated that all convicts, which includes not only those of January 8, but also (PL), would be contemplated with their project, as the text must deal with changes in the Penal Code-which would retroactive to all.
“You can’t say valley for this [condenado] And it’s not worth it. It will be for everyone. Some articles will serve everyone, “Paulinho said at a news conference this Tuesday (23) after meeting with the MDB bench.
There is a resistance from the left and part of the center, but also to benefit the considered mentors of the attempted coup or, at least, to benefit them to the same extent that those convicted of attacks on the three powers.
The changes considered by Paulinho, according to deputies who follow the conversations, seek to make this differentiation between the central core of the coup plot and the protesters, which could contribute to attract votes from the left.
“Those who have attacked democracy and democratic rule of law will be out. [de janeiro] They will be loose, “said Paulinho.
Both Bolsonaro and his January 8 supporters were convicted of the same crimes: violent abolition of the Democratic Rule of Law, coup, criminal organization, qualified damage and deterioration of heritage.
“The vast majority had four or five crimes imputed. Some of these crimes will have the penalties reduced and then the supreme who will decide this amount,” said Paulinho on Tuesday (23).
A draft project obtained by Sheet .
The proposal must undergo modifications until it is filed – part of the adjustments made by suggestion of STF ministers “for inaccuracies” in the words of a negotiator. This draft provides no differentiation between organizers and participants, nor does it raise penalties to organizers or financiers.
The proposal reduces the penalty of the crime of violent abolition of the Democratic Rule of Law, arrest of 4 to 8 years to between 2 and 6 years. The crime of coup d’état, today with arrest between 4 and 12 years, would go to 2 to 8 years. In addition, the punishments for these two crimes would no longer add – the less serious crime would be excluded.
The draft also determines that those accused of acting in the context of a multitude will only be punished if there is effective demonstration that they acted combined with the articulator of the coup d’état or attempted abolition of democracy. This would help to deliver part of the convicts by January 8 that they have no proof of depredation or more active acting in the organization of acts.
Now, an option from deputies is to reduce, for example, the deterioration of equity, which would end up reducing the penalties of the convicts. Another alternative, as Paulinho said in an interview with Sheetis to create categories in crimes against democratic institutions, establishing gradations between mentors and executors of a coup attempt.
The rapporteur also said that he can modify the prediction that the penalties of the two crimes against democracy are added – at once, there would be a replacement with the greater of them, which would also reduce the final conviction.
Asked which of the five crimes would have a reduction in penalties planned, Paulinho did not want to specify and said he was reaping suggestions from the benches. This Tuesday, he met with MDB, and the PL – which does not accept penalties, only amnesty. The meeting with the emedebista bench had a telephone call from former President Michel Temer.
Paulinho, however, ruled out measures that benefit criminals that do not have to do with recent attacks on democracy, which excludes the possibility, for example, from reducing predicted penalties for criminal association.
This Wednesday, the rapporteur must meet with PSD, PP, União Brasil, PT, PSDB and other parties countertops.
