The minister will assume on Monday (29) the presidency of the Supreme Federal Court () and the National Council of Justice (CNJ) for the 2025-2027 biennium. He succeeds the minister and will be deputy Alexandre de Moraes, following the tradition of succession by the order of seniority in the court. Known for the technical and reserved profile, Fachin reaches the command of the court in the midst of a scenario of strong political and institutional pressure.

Among the main challenges of their management are the conduct of the latest criminal actions linked to the coup attempt, the analysis of any proposals for convicts of acts of and the preparation for the 2026 presidential elections, when the Supreme Court may re -targets.

Born in Rondinha (RS), in 1958, Fachin is a full professor of civil law at the Federal University of Paraná (UFPR). He is a master and doctor of law from PUC-SP, with postdoctoral in Canada. Before joining the Supreme, in 2015, appointed by the then president, he served as lawyer and prosecutor of the State of Paraná. Between 2022 and 2023, the Superior Electoral Court (TSE) chaired.

At the court, he was rapporteur for major processes, such as Operation Lava Jato after the death of Minister Teori Zavascki, the action that recognized homotransphobia as a crime of racism and the trial that dismissed the thesis from the timeframe to demarcate indigenous lands.

Style and expectations

Fachin’s possession represents the bet on a more discreet management, in contrast to Barroso’s public visibility. It rarely gives interviews and avoids participation in political events. Behind the scenes, ministers believe that it will adopt a driving similar to that, marked by collegiality and self -restarting.

Despite the discretion, Fachin has already stated that he will not move away from public debate when democracy is at risk. During a recent seminar, he stated that the Supreme Court will remain firm in defense of the rule of law: “The court does not have and will not have no way to defend democracy.”

Political context

The new management begins amid external tensions. The court has been the target of attacks from right -wing sectors and international criticism, such as the sanctions imposed by the United States on family members of ministers. In Congress, the possibility of amnesty are condemned by the acts of 8 January, as it should reach the Supreme Court.

With polarized presidential elections ahead, Fachin’s challenge will be to maintain institutional balance and preserve the Supreme’s authority in one of the most sensitive periods in the country’s recent history.
