“We traveled together in a van for about 40 minutes and talked about this possibility [de redução de penas] related to January 8. At that time, it had not yet had the judgment of the former President of the Republic ”said Barroso.
“In the penalties of January 8, I considered it desirable to apply the consumption, that is, to fuse the crime of coup d’état with that of violent abolition of the Democratic Rule of Law in a single punishment. The consumption seemed acceptable to me,” declared.
The minister’s assessment applies only to the case of protesters who invaded the Congress, the STF and the Planalto Palace.
“And that was my vote: I applied smaller penalties in the cases of January 8. I told them [Motta e Alcolumbre] who agreed, who seemed the best way ”he said.
As for the widespread amnesty, the minister said it was a competence of Congress. “But this amnesty, as it has been proposed, is unacceptable because it represents a violation of the separation of powers“.
