President Luiz Inacio Lula da Silva (PT) sanctioned on Monday (29) the law that amends the CLT to guarantee up to 120 additional days of license and maternity pay after the hospital discharge of mothers and newborns.
The standard applies to cases where hospitalization exceeds two weeks and is directly related to delivery, such as prematurity situations or complications at birth.
The act was held during the opening of the 5th National Conference on Women’s Policies (CNPM) in Brasilia, which brings together about 4,000 participants to discuss the updating of the National Policies Plan for Women.

How the rule works
The extension will be discounted from the period already used before delivery. For example: If the mother began the license two weeks before birth, she will be entitled to the remaining time after discharge. The same logic applies to maternity pay, which will also be extended.
The bill was approved by Congress three years after the Federal Supreme Court (STF) decision that set discharge as a starting landmark in cases of hospitalization. The new law goes beyond the decision, ensuring payment during the entire hospitalization period and subsequent extension.
