With the uncertainty of Minister Luís Roberto Barroso, President Luiz Inacio Lula da Silva (PT) already evaluates scenarios of nomination to the Supreme Court (STF) still in the current term.
In an interview with CNNBarroso, who leaves this Monday (29) the presidency of the Supreme Court ,.
The possibility of Barroso leaving the Supreme Court had already been informed to the president, who, to avoid being surprised, say presidential assistants, began to analyze alternatives if he has to indicate a name.
The petista, according to government advisors, has made it clear that he will not anticipate, even out of respect for the magistrate, and therefore will only be leaning over a choice if Barroso’s decision to retire this year is confirmed.
In the Planalto Palace, however, two names are classified as the president’s favorites for a future vacancy to the Supreme Court: that of the Union Lawyer, Jorge Messias, and the Minister of the STM (Superior Military Court) Maria Elizabeth Rocha.
Messiah was Lula’s second option for Minister Rosa Weber’s place. For the post, the former Justice Minister Flávio Dino was nominated. At 45, Messiah would have the advantage of staying in the Supreme Court for thirty years.
In addition, it is considered a confidence name of Lula, with good dialogue with the Federal Senate and with the possibility of gaining support even in opposition because it is evangelical.
Maria Elizabeth fell in favor of the president for her stance ahead of the STM. She said identifying military crimes committed by Jair Bolsonaro and began debate about the loss of patent of the former president.
The name of the minister has the sympathy of the first lady Rosângela Silva, who advocates more women in the Supreme Court. She, however, is 65 years old. That is, if indicated, it would be only ten years at the post.
Senator Rodrigo Pacheco (PSD-MG) is also quoted for a place in the Supreme Court. The president, however, prefers that the senator disputes the government of Minas Gerais in 2026, with the possibility of being nominated for the STF in future vacancies.
This Monday (29), Minister Edson Fachin will take charge of the Supreme Court. With a more moderate and restrained profile, Fachin can represent a counterpoint to Barroso, more affected to public statements.
