Former President Jair Bolsonaro was sentenced to pay the lawyers of federal deputy Guilherme Boulos (PSOL-SP) after losing an action for moral damages filed against the parliamentarian. Bolsonaro fired the court after Boulos publicly pointed him as a possible mentor of the murder of Councilwoman Marielle Franco, which took place in 2018, along with her driver, Anderson Gomes.
The request of the former president, who had already been denied in the first instance, was taken to the Second Appeals of the Special Courts of the Federal District, which maintained the rejection of the appeal. The defense of argued that Boulos’s statements would not be protected by parliamentary immunity, maintaining that protection does not apply to “without nexus with the performance of parliamentary functions or when used for abusive practices.” However, the court understood that the lines were in the context of the deputy’s political action.
With the final decision, the defense of requested the fulfillment of the judgment. Bolsonaro will have to pay the procedural costs and attorney’s fees set at 10% of the value of the case. If you do not make payment within 15 days, it may be penalized with an additional 10% fine and new fees in the same percentage. The judge warned that if the amount is not paid, electronic attachment may be performed via the judiciary’s asset search system (Sisbajud).
