The judge considers that it was not proven that Joana Marques’s video was the cause of financial losses and emotional stress alleged by the singers.

To humorist Joana Marques won the lawsuit Moved by the angels, after the Lisbon Civil Court concluded that there was no causal link between the publication of the humorous video and the duo’s financial losses.

The sentence, signed by Judge Francisca Preto, was communicated through the Citius Portal and puts an end to a process in which Nelson and Sérgio Rosado asked for over one million euros compensation.

The case goes back to April 2022, when the brothers pink sang the national anthem on MotoGP of Portimão. The performance quickly became viral due to technical failures and the intonation chosen by the artists. The next day, Joana Marques edited the original video, combining it with images from the Idols program, suggesting negative jury reactions. The montage was shared on the humorist’s Instagram with the caption “Is that what the April 25 was made for?”

The musicians claimed that the publication caused damage to reputationloss of sponsorships evaluated in about 200 thousand euros and psychological suffering, even referring threats from nationalist groups. In the process, they required compensation for property and moral damages, including 50,000 euros for each person personal.

However, the judge understood that not proven that the damage resulted from the video of Joana Marques, not the original transmission itself or the following mediaism. The magistrate also recalls that the duo’s income did not show the crisis described by the singers, as the revenue in 2022 reached 517 thousand euros, twice the one recorded in previous years.

During the trial, Joana Marques defended the humorous character of her publication, stating that she did not incited hate comments against the musicians. “I have responsibility for my actions, not about the reactions of others,” he said.

In a statement, the angels announced that will not appeal the decision. The case, which rekindled the debate on the limits of freedom of expression and satire, ends with the judicial victory of Joana Marques.
