Reform limits home office of public office to 20% and prohibits commissioners

The text of the administrative reform that should be filed by the rapporteur Pedro Paulo (PSD-RJ) on Thursday predicts that the remote work of public servants will be limited to 20% of the body’s labor force. In addition, the proposal provides that the face -to -face modality is mandatory for commissioned, and trustworthy positions.

That is: every day, a maximum of two out of ten servers will work from home. Exceptions will be allowed, but by justification of the need. Currently, the operation of the teleworking depends on the rules of each organ.

The proposal also establishes that the face -to -face modality will be mandatory for employees who occupy commission positions and strategic trust functions. The “first level” (ministers, state and municipal secretaries, and equivalent in the three powers and autonomous bodies) will not be subjected to this rule.

In addition, home office servers cannot live elsewhere from the city where the position is crowded, except for positions that are in full teleworking regime.

It is also prohibited that servers in this modality live abroad, unless there is some express authorization of the maximum authority of the agency, which can only be granted in case of the need to accompany a spouse that is at the service of Brazil abroad.

The performance evaluation also provided for in the reform proposal will serve as one of the preference criteria in choosing servers that may adopt the teleworking regime.

The proposals package changes more than 40 articles of the Constitution and is structured in four major axes: governance and management, digital transformation, professionalization and extinction of privileges. The rapporteur is already in search of the 171 signatures necessary to enter the matter.

Among the other devices, PEC creates a single remuneration table for all federation entities within ten years, requires mayors, governors and presidents to present strategic goals of goals within 180 days after inauguration, institms periodic performance evaluations for server and authorizes the payment of outcome bonuses of up to four remuneration per year for strategic positions.

With the proposal, Congress is preparing to reopen a sensitive debate of great political impact: the reconfiguration of the rules of civil service and the attempt to impose fiscal discipline in a historically resistant sector. The text is expected to go to Plenary in November.
