The action was filed by the Amor for Sao Paulo coalition of the defeated candidate (-SP). The prosecution argued that on these occasions, interlocutors would have made explicit voting requests in favor of the Nunes – Mello Araújo plate.
In Itaquera, for example, subprefect Rafael Limonta praised the qualities of the then candidate for reelection and made veiled criticism of opponents: “Ricardo Nunes is faithful. The others did not and lost their chance. We need to be on the right side.”
In the process, the coalition requested the revocation of the records or diplomas of Nunes and Mello Araújo, as well as the declaration of ineligibility of the plate. Alternatively, it requested the application of a fine for prohibited conduct and abuse of power, claiming that the mayor and the deputy benefited from public structures during the campaign.
The magistrate, however, understood that there was not enough gravity to compromise the outcome of the election, removing the revocation of the registration or diploma and the ineligibility. The value of 15 thousand fine for each corresponds to the three events in which irregularities were recognized.
The defense maintains that the mere mention of the mayor during the delivery of equipment does not characterize violation of administrative impersonality, nor breakdown of electoral isonomy or affront to current legislation.
In addition, he points out that Ricardo Nunes and Mello Araújo did not participate in the ceremonies described in the action.
“They are illegitimate part to respond to this process. The speeches are attributed to third parties who are not even defendants. Mello Araújo had no position in the city at the time,” says lawyer Ricardo Penteado.
