O Promotes this Monday (6) a public hearing to discuss pejotization in labor relations. The phenomenon occurs when companies hire service providers as a legal entity to escape the labor bond. The debates will be opened at 8am, by Minister Gilmar Mendes, rapporteur of the actions dealing with the issue, and will be attended by experts in labor law, union representatives, Public Prosecution Service (MPT) and business sectors.

In April this year, the minister suspended all actions on the subject that is being processed in the country and summoned the public hearing. The proceedings will only be processed again after the Court’s decision on the legality of pejotization. The judgment date was not set. In determining the public hearing, He said the debates will help examine the issue and define beacons for hiring self -employed and legal entities.

After the minister’s decision, entities representing labor magistrates and the sectional of the Brazilian Bar Association in São Paulo (OAB-SP) defended the jurisdiction of the Labor Court to judge cases involving pejotization. Pejotization is a term used to characterize hiring workers as legal entities by companies. PJs, as they are called, do not have a signed work card. This modality gained strength with the labor reform of 2017, which allowed the outsourcing of work for the company’s core activities.

Since then, thousands of lawsuits have reached the Labor Court Courts, and workers hired as PJ began to seek the recognition of employment. According to the Labor Prosecutor’s Office (MPT), from 2020 to March 2025, 1.2 million labor complaints were filed because of outsourcing.
