The United States Customs and Border Protection (CBP) reported last Friday (10) that the STF minister, Alexandre de Moraes, used misleading information when ordering the arrest of Filipe Martins, former advisor to Jair Bolsonaro (PL).
According to the agency, the false information served as the basis for Martins’ “arrest or conviction”. Bolsonaro’s former advisor is a defendant in the coup plot accusation, but has not yet gone to trial.
The US agency claims that Moraes cited false customs data to claim that Martins entered the country on December 30, 2022. CBP stated that it “strongly condemns any misuse of this false entry information to support the arrest or conviction of Mr. Martins or any other person.”

In the note released by CBP, they describe Moraes as “an individual who was recently sanctioned by the United States for human rights violations against the Brazilian people”. Furthermore, they pointed out that the “agency will take appropriate measures to prevent future discrepancies from occurring.”
Recently, President Luiz Inácio Lula da Silva (PT) asked Donald Trump’s government to reevaluate the sanctions on Brazilian judges, which contrasts with the mention of Alexandre de Moraes in the note published by the CBP. Last Monday (6), Lula spoke by telephone with the North American president about the sanctions and tariffs that the USA had imposed on Brazil.
Former advisor Filipe Martins is being accused by the Attorney General’s Office (PGR) of collaborating in the coup d’état plan in favor of former president Jair Bolsonaro after his defeat by Lula in 2022. Martins is part of core 2 of the complaint, which has not yet been analyzed by the 1st Panel of the STF.

Martins was preventively arrested in February 2024 in the Federal Police’s Tempus Veritatis operation. According to the arrest order, he would have gone to the United States together with Bolsonaro so that he could “escape investigations”, but the American agency states that he did not enter the country on the date stated in the arrest order.
Filipe Martins’ lawyer, Jeffrey Chiquini da Costa, declared in a video released on Friday that minister Alexandre de Moraes could “be criminally liable” in the United States for “having used a false document”.
Despite the allegations made by the defense and the US agency, the PGR did not base the accusation solely on this fact.

CBP Statement on Review of Filipe Martins Entry Records

WASHINGTON – U.S. Customs and Border Protection (CBP) announced that it has conducted a thorough review of available evidence related to allegations of entry into the United States by Brazilian citizen Filipe Martins on December 30, 2022. Upon completion of the review, it was determined that Mr. Martins did not enter the United States on that date.

This conclusion directly contradicts the allegations made by the Minister of the Federal Supreme Court of Brazil, Alexandre de Moraes, an individual who was recently sanctioned by the United States for human rights violations against the Brazilian people.
We recognize that Minister Alexandre de Moraes cited an erroneous record to justify Mr. Martins. The inclusion of this incorrect record in CBP’s official systems remains under investigation, and the agency will take appropriate action to prevent future discrepancies from occurring.
CBP strongly condemns any misuse of this false entry information to support the conviction or arrest of Mr. Martins or anyone. We reaffirm our commitment to maintaining the integrity of border records and defending the principles of justice and human rights.
