Austrian Josef Fritzl, sentenced to life imprisonment for being imprisoned and raped his daughter for many years, will not yet be conditionally released. The Krems Court of Krems dismissed the petition for early release, which was filed in August by its advocate Astrid Wagnerová. It confirmed it on Monday APA, writes TASR.
This decision is not yet final, as Wagner appealed to him to the High Regional Court in Vienna. She described the verdict of the court in the quartz as “wrong”.
Fritzlova’s defense attorney claims that the decision of the Krems Court in Krems is contrary to the expert opinions that the 90-year-old client in the meantime is no longer a threat to the public. As he suffers from progressive dementia, he wants to place it in the appropriate medical facility, which he considers to be a better place for him than a prison.
In May 2024, Fritzla was moved on the basis of a court decision in Krems from a correctional facility to a normal prison. The court already dismissed his conditional release. In the reasoning of the application, Wagner said in August that Fritzl had served for more than 15 years, meeting the legal conditions for conditional release.
However, the court in Krems in its current decision reiterated that Fritzl continues to show aggression against his family members, so it cannot be ruled out that it continues to pose a threat. Moreover, he is not ready to live at liberty, as there is no one to take care of him and has nowhere to live.
From August 28, 1984, Fritzl imprisoned his then 18-year-old daughter in the cellar of a family house in Amstetten, where he repeatedly raped it for the next 24 years and begotted seven children with her. One of them died shortly after birth. She learned about his crimes in April 2008. A year later he was sentenced to life imprisonment for rape, incest, enslavement and killing of negligence. In May 2017 it was announced that he had his surname to Mayrhoff in prison.
