For the STF minister, risk of flight and conviction for a coup authorize the maintenance of the precautionary measures imposed on the former president
Minister Alexandre de Moraes, of the STF (Supreme Federal Court), denied this Monday (13.Oct.2025) the request from the defense of the former president (PL) to revoke house arrest imposed on August 4, 2025. The judge considered that the ex-president’s claim for a coup d’état and the risk of escape are sufficient to authorize the maintenance of the precautionary measure.
“The guarantee of public order and the need to ensure the full application of criminal law justify the maintenance of house arrest and other precautionary measures, as a substitute for preventive detention, making Criminal Justice and the right to freedom compatible in a reasonable, proportional and appropriate manner.“, stated the minister.
BOLSONARO CONDEMNED
The 1st Class of STF (Supreme Federal Court) (PL) on September 11, 2025 for 5 crimes, including attempted coup d’état. They voted to convict the former president and the other 7 defendants: (rapporteur), , and (president of the 1st Panel).
Luiz Fux was. The minister voted to condemn only and for violent abolition of the Democratic Rule of Law. In the case of the other 6 defendants, the magistrate decided to acquit them.
