Judiciary reaches agreement to share procedural fees – 10/13/2025 – Brasília Hoje

A reached an agreement to share the amounts collected with the costs of the Federal Justice with the (Federal Public Ministry), (National Council of Justice) and (Federal Public Defender’s Office.

The terms of the agreement were communicated this Monday (13) to the president of the Senate, (União Brasil-AP). The presidents of the STF (Supreme Federal Court), the STJ (Superior Court of Justice), and the head of the PGR, participated in the meeting.

The agreement provides that 80% of the money from Federal Justice costs will be paid to the first and second instance courts, to finance the modernization of the Judiciary, with technology, training and infrastructure.

The remaining 20% ​​will be divided between the MPF (9%), the CNJ (6%) and the DPU (5%). These bodies entered the dispute for the money under the argument that they are part of the Justice system.

A bill dealing with Federal Justice costs was approved in 2024 in the Chamber and stalled in the Senate, without an agreement between the bodies linked to the Judiciary. The rapporteur of the proposal, senator Eduardo Gomes (PL-TO), decided to wait for an understanding led by the CNJ to proceed with the proposal.

Court costs are a fee paid by the parties to a case to cover the services necessary to carry out a legal action. The law that defines the values ​​dates back to 1996 and stipulated that the cost would be calculated based on a Reference Fiscal Unit, the UFIR.

It turns out that the UFIR was extinguished in 2000, and the amounts of Justice costs ended up frozen over time, without covering the administrative and operational expenses of the Federal Court.

In practice, the text of the proposal in the Senate updates the values ​​of Justice costs and provides for their readjustment every two years according to the IPCA (Broad National Consumer Price Index).

The highlights are civil actions in general, whose value equivalent to 2% of the case must be transferred to the Special Fund for Federal Justice — responsible for managing the costs of Justice and investing in improvements to the Judiciary. This amount will be a minimum of R$112 and a maximum of R$62,200.

In criminal actions, the fixed amount per convict will be R$448, and the criminal review will cost R$168.
