When the President of the Republic goes public to say that he does not intend to nominate “a friend” to the Federal Supreme Court, that by keeping it, he unintentionally exposes the distortion present in these choices. There are several governments.
It is not, or should not be, an option for the agent to choose based on substantive preparation for the role. It is the Greater Law that establishes the criterion of notorious knowledge. As for the requirement of friendship, this is what, along with the Palace’s trust, influence in politics and the liking of the country’s peers, has been placed at the table of speculation about the attributes of the most highly rated.
There are three, as the news informs us daily: , attorney general of the Union; , senator for the PSD of Minas Gerais; and, minister of the Federal Court of Auditors.
No word was written about them or said about their notorious legal knowledge. It is possible that they have this knowledge which, however, does not fit into the concept of notoriety because it is not talked about. The main credential is, therefore, relegated to the level of irrelevancies.
Of Messias, religion and closeness to the president stand out; from Pacheco, the support of the president of the Senate and the sympathy of court ministers; of Dantas, the good relationship between the three Powers.
Such requirements prevail, are seen naturally and taken into account with the utmost seriousness — when it is normal for them to be secondary. It also follows from this that the means and methods of the hearings in the Senate were incorporated into the tropical landscape.
The dynamics have changed, although not exactly for the better. In the past, rapapés reigned and lately they are still present, but with the addition of those demonstrations made to cut off the internet. The consistency of the debate regarding the scrutiny of legal knowledge continues to be lacking.
The bad news is that there is no chance of changing. The way it is, it’s easier for everyone, it saves you the trouble of thinking.
