The leader of the PT in the Chamber, (RJ), called the (Attorney General’s Office) this Wednesday (14) against the Bolsonaro offensive to try to stop the decree that makes the services of the Personal Office of the Presidency available to First Lady Rosângela da Silva.
The criminal representation against the former first lady is a response by the PT member to the 15 draft legislative decrees against the measure that determines that the .
“I want to vehemently repel the unnecessary and senseless persecution against First Lady Janja Lula da Silva, with the protocol of 15 PDL’s without legal basis and renew that the attacks will be retaliated against eye for an eye and a tooth for a tooth”, says the PT leader.
He states that the decree is based on the Constitution and argues that there is no creation of a new position, expense or body. “Therefore, there is nothing illegal in the Presidency’s decree, contrary to what Bolsonaro’s group did when it was in power”, he adds.
The representation filed by Lindbergh is based on the TCU’s ruling, led by the former first lady. He requests that a criminal investigation be opened to determine the facts described in the document and the possible criminal and civil liability of the authorities involved.
“The TCU pointed out that there was direct political interference in the choice of organizations, highlighting the case of the Brazilian Transcultural Missions Association (AMTB), nominated by Minister Damares Alves, without a regular selection process”, he writes.
According to the document, the ruling says that the structure of the program represented an illegal allocation of resources, “since the Civil House acted as a manager of private donations, with no provision in budgetary legislation.”
The representation speaks of the crime of embezzlement, which “is consummated when the public agent, due to his position, gives different destinations to values under his possession or administration”.
It also cites malfeasance, “when the public agent delays, fails to perform or performs an official act against legal provisions, to satisfy personal interest or political or ideological feelings”. Other crimes mentioned are criminal association and administrative improbity.
In March, Lindbergh promised to file two requests for information about Michelle for every such request made by the opposition against Janja.
