The Sixth Class of STJ (Superior Court of Justice) annulled, this Tuesday (14), the conviction and ordered the suspension of the criminal action against Francisco Mairlon Barros Aguiarwho had been in prison for 15 years for the case known as Crime yes 113 roll.
The annulment of the conviction was motivated by an appeal filed by the accused’s defense, made by the NGO Innocence Project Brasil, a non-governmental organization that works to defend those unfairly convicted by the courts.
The STJ’s decision was taken after the court annulled, in September this year, the to 61 years in prison.
The convictions of Adriana and Francisco were based on a confession obtained by the police and in the accounts of those involved, although these confessions were not confirmed in the judicial phase.
The STF annulled the two convictions after recognizing procedural irregularities in the case.
Penalties and annulments
Mairlon was sentenced to 47 years in prison for murder and aggravated robbery. This is inadmissible, since the conviction was based solely on elements of the police investigation, without confirmation under the scrutiny of the judicial process.
This recent annulment follows the September 2025 decision of the same STJwhich overturned the conviction of Adriana Villeladaughter of the victims and accused of being the mastermind of the crime.
Adriana had been sentenced in 2019 to 67 years in prison, later having the sentence reduced to 61 years. The defense of both claims that they were falsely accused by the doorman Leonardo, the supposed real killer.
Remember the case
O crime refers to the triple homicide that occurred on August 28, 2009, in Brasília, killing the retired TSE minister José Guilherme Villelathe lawyer Maria Carvalho Mendes Villela and the couple’s employee, Francisca Nascimento da Silva, in addition to involving the accusation of qualified theft.
The case became widely known as Crime yes 113 rollalluding to the residential block in Brasília where the bodies were discovered. The three victims were stabbed to death in the apartment where they lived on block 113 of Asa Sul.
After the investigation, Adriana Villela, the couple’s daughter, was accused of being the mastermind behind the crime. According to the process, the executors were a former doorman of the building, Francisco and another accomplice. The motivation would be money.
Adriana’s defense always maintained, however, that the doorman committed the crime alone.
