The minister was discharged from Hospital Sírio-Libanês, in Brasília, where he had been admitted since Wednesday (15). In the final stretch at the (Federal Supreme Court), he is trying to reduce his caseload and resume trials that he interrupted in recent months. Barroso reconciled the analysis of the processes with agendas with authorities and friends and get-togethers until the virus was suspected. He was discharged this Thursday at around 12:45 pm. “Doctors at the Sírio Libanês Hospital are still awaiting test results, but have released the minister to continue taking medication at home”, informed the Supreme Court’s press office.
The guidance that Barroso gave to his office staff was to maintain the process analysis routine and prepare for the virtual plenary trial that begins this Friday (17). He decided that he will not participate in the physical plenary sessions of the Supreme Court.
On Tuesday (14), Barroso was honored at a dinner hosted by lawyer Murillo de Aragão at his home in Brasília. Ministers of the Supreme Court, congressmen and members of the government (PT) were at the event.
On Wednesday (15), Barroso’s office prepared a farewell party for him. The minister’s hospitalization suspended the festivities agenda. He complained of feeling unwell during the day, suspected of having a virus, and spent the night in hospital for a series of tests.
Earlier on Wednesday, Barroso hosted meditation teacher Erica Berto for an audience. She offers quality of life courses at Brahma Kumaris, a spiritual movement in which Barroso will participate at the end of the month.
Since leaving the presidency of the Supreme Court, the magistrate and his team began to dedicate themselves to analyzing the cases he kept in his collection and those he received from Edson Fachin, who assumed the presidency of the court.
From September 29th to Tuesday (14th), Barroso granted 237 court decisions in different cases. The number represents 84% of all decisions made by him during the year.
The increase in the number of decisions made by Barroso after leaving the presidency is common because, upon returning to the Supreme Court, the minister takes over the new president’s collection and needs to dedicate himself to his new processes.
These decisions dismissed 34 cases from its file. The minister will leave around 900 actions for analysis to his successor — complaints, with 304 cases, are the most recurrent type in the cabinet.
He informed his colleagues that he will stay at the Supreme Court until Saturday to participate in the virtual plenary that begins this week. He released five actions for trial and prepared the votes in all cases.
Barroso also intends to release a case for trial in which he requested reviews (more time for analysis). This is the process that discusses whether it can be charged from 2022 or only from 2023.
The former president of the Supreme Court interrupted the trial when there was only one vote left to form a majority due to the theory that the difference can be charged from 2022.
He is in suspense about his possible vote in the action that discusses up to the 12th week of pregnancy.
Barroso interrupted the trial in a double act with the retired minister. She was the case’s rapporteur and was about to retire from the Supreme Court when she decided to release the case for trial.
She presented a long vote on abortion up to the 12th week of pregnancy in the trial in the virtual plenary of the Supreme Court. Barroso then asked for prominence — the mechanism by which a minister can take the trial to the physical plenary.
He is ready to vote, but expressed doubts about the relevance of reopening the trial. Questioned after the announcement of his retirement, he stated that he believes that Brazilian society still does not have a clear distinction between being personally against abortion, but in favor of the decriminalization of the practice.
“I can still vote because it’s not over. But the consideration I’m making is: we are already living in a moment with many delicate issues happening at the same time and the risks of a divisive decision creating an even more turbulent environment in the country,” he declared.
One of the possibilities he suggested was to look for a double like the one made with Rosa. Supreme Court’s colleagues, however, are not very willing to interrupt the trial again.
According to Barroso’s assistants, the tendency is for the vote on abortion not to be presented.
The minister decided to bring forward his retirement from the Supreme Court after wearing the toga for 12 years and 3 months. He could remain on the court until 2033, but said he chose to slow down.
“I feel that now is the time to follow other paths. I don’t even have them well defined, but I have no attachment to power and I would like to live a little more of the life I have left without the public exposure, obligations and demands of the position”, he said in the plenary of the Supreme Court on Thursday (9).
“I don’t have any regrets nor have I ever been afraid of anything. And I don’t say this out of pretension or arrogance, but because of my deepest belief, that the universe protects people who move for good purposes”, he added.
